Tirana, January 31, 2014/Balkan Independent News Agency

President of Republic, Bujar Nishani has reacted over the overthrow of his two decrees relating to the proposal for appointment of Mr. Petrit Ceno and Mr. Gjovalin Pernoca as members of the Supreme Court.

In an official reaction, the head of the state says that with the proposal of the parliamentary law committee and the votes of the majority, parliament overthrew the nominees for the Supreme Court in two occassions.

According to the president, the reason brought by that Committee according to which the two candidates do not meet the condition to posses the specific formation on the administrative right, is a simplified judgment, an unfounded reasoning, a far-fetched justification.

“In all the decision-makings as the President of the Republic I am convinced and would abide only to the Constitution of Albania and I am determined to guarantee any citizen of the Republic of Albania that they will find at the President, a guarantor of the entirety of the constitutional principles.

This spirit has been followed during the candidates’ selection process, during the cooperation with the Assembly’s representatives all the way to the decreeing of High Court members.

Based on the constitutional obligations and the Law “For organizing and functioning of the High Court, of the Republic of Albania” which as it is known has been amended with wide approval and consensus, we accomplished this process by making the public announcement about the launch of procedures, we publicly announced the concrete names of the candidates who met the legal conditions, procedures that were made present during the consulting process with representatives of the parliamentary groups.

I especially appreciated the cooperation process with the Assembly’s representatives and their agreement about the concrete conditions and criteria based on the list of competitors for a qualitative composition of the High Court”, states the reaction of the president of republic.

The president further says that, what took place with the voting is a clear indicator that the political consensus reached between the sides following the request of the European Union for the new Supreme Court Law, convinces anyone that the consensus in question did not pass the test. /ibna/
